American Samoa
No form of cannabis is legal in American Samoa. First-time possession is a felony and the American Samoan government has stated that violators will receive a mandatory minimum sentence of 5 years imprisonment, a $5,000 fine, or both. This includes cannabis that has been obtained legally in another jurisdiction.
American Samoa does not have a medical marijuana program. More importantly, CBD products are not legal in the territory. Though hemp-derived CBD that contains less than 0.3% THC is legal under federal law, a judge in American Samoa ruled in 2019 that “CBD oil is marijuana regardless of whether or not it is psychoactive and unless and until the Fono [the Legislature of American Samoa] tells us otherwise.”
